These Terms & Conditions ("Terms") form a legal agreement between you ("Client", "User", or "You") and NVMELESS ("We", "Us", or "Our") governing the use of our system setup services, websites, automations, and client management tools provided under the NVMELESS brand.
By engaging our services, submitting payment, or accessing your system dashboard, you agree to abide by these Terms.
1. Overview of Services
NVMELESS provides done-for-you systems designed to simplify
client management, appointment booking, lead generation, and communications.
This includes but is not limited to:
Fully branded booking funnel(s)
Calendar integration for appointments
Email and SMS automation setup
CRM (customer relationship management) pipeline setup
Dashboard access for managing leads, bookings, and
communication history
Visual identity or brand styling (when purchased)
Website or landing page design (when purchased)
Ongoing support, monitoring, and updates under a monthly plan
All systems are cloud-hosted and accessed via secure login credentials provided at onboarding.
2. Payment Terms
2.1 Setup Fee
A one-time setup fee is required before the initial build begins. This fee covers planning, design, technical configuration, system testing, and deployment. It is non-refundable, regardless of future use or cancellation.
2.2 Subscription Fees
All services require an active monthly subscription to maintain:
Hosting
Automation delivery (email/SMS)
Dashboard access
CRM functionality
Ongoing support and maintenance
Late or failed payments will result in service suspension after a 7-day grace period. Reinstatement may require administrative fees.
2.3 Cancellation Policy
You may cancel at any time via written request. Your service will remain active until the end of your billing cycle. We do not offer pro-rata refunds for unused days. Missed payments may result in loss of access and data.
3. Scope of Use
Your NVMELESS system is licensed to you for internal business use only. You may not resell, sublicense, or rebrand it without written permission.
You agree to:
Use the system for lawful purposes
Maintain confidentiality of login credentials
Ensure team members use the platform responsibly
Notify us of any errors, issues, or misuse
We retain the right to suspend or terminate access in cases
of abuse, fraud, or breach of these Terms.
4. Intellectual Property
All funnels, websites, automations, templates, graphics, workflows, and assets created by NVMELESS remain our intellectual property unless otherwise agreed in writing.
You are granted usage rights for as long as your subscription remains active. Upon cancellation, we may revoke access and deactivate the system.
If you wish to export or own the system outright, this must be arranged via a separate licensing or white-label agreement.
5. Limitation of Liability
While we take every measure to provide a stable, high-performing system, you acknowledge and agree that NVMELESS:
Cannot guarantee uninterrupted service
Cannot ensure leads will convert into customers
Is not responsible for platform outages, server errors, or software issues that may impact functionality
You expressly agree that NVMELESS shall not be held liable for any loss of revenue, missed appointments, business disruptions, or reputational damage resulting from any of the following:
Third-party tool or service failures
Network issues or user-side connectivity
Missed or undelivered email/SMS due to carrier restrictions
Misuse or misconfiguration of the system by the client or their team
Data deletion, overwriting, or missed backups due to user action
Use of the system is at your own risk, and you are advised to test and verify all automations, forms, and booking flows before using them in live business settings.
6. Client Responsibilities
To ensure a successful setup and ongoing functionality, you agree to:
Provide all required business, branding, and account information in a timely manner
Test your booking link, calendar, and automations before promoting them to the public
Monitor your account usage to ensure proper function
Comply with relevant data protection and email/SMS communication laws (e.g. GDPR, PECR)
You are solely responsible for how your customers' data is
used once collected through your system.
7. Data Protection & Privacy
We take data security seriously and implement industry-standard protections to ensure your system and contact data are safe.
Your data is never sold or shared with external vendors
Your login is protected by encryption and server-level access control
All email/SMS messaging is processed through secure, GDPR-compliant infrastructure
You are responsible for informing your clients and leads of how their data is used. NVMELESS does not offer legal compliance services; we recommend consulting a solicitor for GDPR, marketing consent, or privacy policy compliance.
8. Service Changes & Amendments
We reserve the right to update or change these Terms. Any updates will be posted publicly and emailed to you when applicable. Continued use of the NVMELESS system after changes constitutes acceptance of those terms.
We also reserve the right to adjust service offerings, pricing, or features based on business needs, software changes, or platform updates.
